Pool — Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Pool Labs Inc., a Delaware corporation ("Pool", "we", "us"), governing your use of the Pool mobile app, the poolapp.co website and related services (together, the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. What Pool is — and is not
Pool is software that helps a group of friends track equal contributions to a shared pool, log expenses against it, split them, and see who owes whom.
Pool is not a bank, a money transmitter, a payment processor, an escrow agent, a lender or a financial adviser.
- Pool does not hold, custody, transmit or move money. In the current release, "deposits", "balances" and the "card" shown in the wallet feature are a simulated ledger — no card is charged, no funds are held, and the demo card number cannot be used to pay for anything.
- All real payments between members happen outside Pool, on third-party services (Venmo, Cash App, PayPal, Zelle, Interac e-Transfer) or in person. Pool only records what members report about those payments. Your use of any third-party payment service is governed solely by that service's terms.
- The balances, splits and "who owes whom" figures Pool shows are arithmetic derived from what members enter. Pool does not verify that an expense was real, that an amount was correct, or that a reported payment was actually made.
- Pool has no FDIC or other deposit insurance. Nothing in the Service is stored value, and "Pool Points" (§8) are not money.
If we later introduce real payment features, they will be offered under additional terms that you must separately accept.
2. Eligibility and your account
- You must be at least 18 years old and able to form a binding contract. We verify age by date of birth at signup and may terminate accounts found to be under-age.
- You must provide accurate information and keep it current. You may hold one account.
- You are responsible for everything that happens under your account. Keep your sign-in email secure; anyone who can read your email can sign in to Pool. Use "Sign out of other devices" and "Forget this device" in Account security if you suspect misuse, and tell us at support@poolapp.co.
- You may use Sign in with Apple or Google; your use of those services is subject to their terms.
3. Payment handles — your responsibility
When you store a Venmo, Cash App, PayPal, Zelle or Interac handle, the app shows you the exact text that will be saved and requires you to confirm it. That handle is then shown to members of your pools as the place to send you money.
You are solely responsible for the accuracy of every handle you confirm. Pool does not and cannot verify that a handle belongs to you, is spelled correctly, or is active. Pool is not liable for any payment sent to a wrong, mistyped, outdated or fraudulent handle, whether stored by you or by another member, and cannot reverse, recall or refund any such payment. Before sending money, verify the recipient inside the payment app you are using.
4. Pools, members and disputes between users
- Each pool has an owner who may grant permissions to co-admins. Owners and admins decide who joins, who is removed, and when a pool closes. Pool the company plays no role in those decisions.
- House rules a pool displays (e.g. "students only", "21+") are written by that pool's owner. They are advisory only — Pool does not verify or enforce them, and the approving admin is solely responsible for membership decisions.
- Any disagreement about an expense, a split, a balance, a settlement or a payment is between the members involved. Pool is not a party to it, does not adjudicate it, and has no obligation to mediate, reverse entries or compensate anyone. The audit trail (Privacy Policy §7) exists so members can see what was recorded and when.
- If a member leaves or deletes their account, their entries remain in the ledger (anonymized) so the remaining members' balances still add up. A leaving member's unsettled balances are not extinguished by Pool.
- Public pools publish the information described in Privacy Policy §5, including their position on leaderboards; owners can opt a pool out of leaderboards or make it private at any time.
5. Acceptable use
You agree not to:
- use the Service for anything unlawful, including money laundering, fraud, or evading financial regulation;
- use the Service to run a business, commercial pool, gambling pool, investment scheme, or to collect money from the public;
- harass, threaten, impersonate or defame anyone; post slurs, hate speech, sexual content involving minors, or content that infringes others' rights;
- enter false expenses or settlements, manipulate balances, or misrepresent payments;
- scrape, enumerate or bulk-collect other users' information, including public pool rosters or leaderboards;
- circumvent rate limits, killswitches, the age gate, the force-update gate, or any security control; probe for or exploit vulnerabilities (report them to support@poolapp.co instead);
- reverse engineer the app except where the law forbids us from prohibiting it; or
- create accounts on behalf of others or with an email you do not control.
We may remove content, suspend or terminate accounts, and refuse service for violations, with or without notice. We may also do so where required by law or by Apple's or Google's platform rules.
6. Your content
You keep ownership of what you post (names, descriptions, messages, photos, receipts, profile text). You grant Pool a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and transmit that content solely to operate, secure and improve the Service (for example: showing a pool to its members, scanning a receipt, sending a notification, matching interests, keeping an audit trail). This licence ends when you delete the content or your account, except for copies retained as described in the Privacy Policy (audit trail, safety-report snapshots, other members' ledger).
You are responsible for your content and warrant that you have the right to post it. Pool may (but is not obliged to) remove content that violates these Terms. Pool runs an automated word list over pool names, descriptions, tags and house rules; it may produce false positives, and rejection of a name is not an accusation.
7. Safety, blocking and reporting
Pool provides block, mute and report tools and a moderation process (triage within 24 hours, resolution within 72 hours — the same commitment the app itself states to reporters). Reports are reviewed by Pool staff; outcomes may include content removal or account suspension. Filing knowingly false reports is a violation of §5. Blocking is not disclosed to the blocked person.
8. Pool Points
Pool Points are an in-app engagement feature. Points have no cash value, are not money, credit, stored value or property, cannot be purchased, sold, transferred or redeemed for money, and confer no rights other than in-app recognition and early access to features Pool may offer at its discretion. We may change how points are earned, adjust or remove points, or discontinue the feature at any time without liability.
9. Software, updates and beta features
- The app may download and install updates automatically, including over-the-air JavaScript updates, and may require you to update from the App Store / Play Store before continuing. Pool may block versions it no longer supports.
- Features labelled beta, preview, "coming soon" or "early access" (including the Pool Card) are provided as previews, may change or be withdrawn, and are not promises of future functionality.
- Staging and test builds may be reset or wiped at any time without notice; do not rely on them.
- Pool grants you a personal, revocable, non-transferable licence to use the app on devices you own or control, subject to these Terms and the applicable app-store terms.
10. Third-party services
The Service relies on and links to third-party services (payment apps, Apple, Google, AWS, OpenStreetMap, others listed in the Privacy Policy). Pool does not control them and is not responsible for their availability, accuracy, security, fees or conduct. Map data is © OpenStreetMap contributors.

Our Privacy Policy explains what we collect and how we use it, and forms part of these Terms.
12. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. Without limiting this, Pool does not warrant that balances, splits, settlements or any figure displayed are correct or complete, that any user is who they claim to be, that any payment handle is accurate, or that any payment reported in Pool was made or received. Some jurisdictions do not allow the exclusion of implied warranties; in that case the exclusions apply to the fullest extent permitted.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, POOL, ITS DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, PROFITS, DATA, GOODWILL OR OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, however caused and under any theory of liability, even if advised of the possibility. In particular, Pool is not liable for: money sent to the wrong recipient or to an inaccurate handle; money owed to you by another user that they do not pay; losses from disputes between users; unauthorized access resulting from your email or device being compromised; errors in figures entered by users; or unavailability, data loss or changes to the Service.
POOL'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID POOL FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM (CURRENTLY $0) OR (B) US $100.
Some jurisdictions do not allow certain limitations; in those, Pool's liability is limited to the greatest extent permitted.
14. Indemnification
You will defend, indemnify and hold harmless Pool and the persons listed in §13 from any claim, loss, liability, damage and expense (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms, your violation of law or of another person's rights, or any dispute between you and another user.
15. Termination
You may delete your account at any time in the app. We may suspend or terminate your access at any time for breach of these Terms, for legal or safety reasons, or if we discontinue the Service, with notice where practicable. Sections 1, 3, 4, 6, 8 and 12–17 survive termination.
16. Dispute resolution, arbitration and class-action waiver
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in St. Louis, Missouri or by video, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for intellectual-property or unauthorized-access claims. You and Pool each waive the right to a jury trial and to participate in a class, collective or representative action. You may opt out of arbitration by emailing support@poolapp.co within 30 days of first accepting these Terms.
17. Governing law and general terms
- These Terms are governed by the laws of the State of Missouri and applicable US federal law, without regard to conflict-of-law rules. Subject to §16, courts located in St. Louis County, Missouri have exclusive jurisdiction.
- Apple / Google: these Terms are between you and Pool, not Apple or Google. Apple and Google have no obligation to provide maintenance or support and are third-party beneficiaries of these Terms with the right to enforce them against you.
- If any provision is unenforceable it will be modified to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
- Changes: we may update these Terms. Material changes will be announced in the app or by email at least 14 days before taking effect, except changes required by law or for safety, which are effective immediately. Continued use after the effective date is acceptance.
- These Terms and the Privacy Policy are the entire agreement between you and Pool about the Service.
